Services Provided Property Rental Leases Property Rental Leases Malta and Gozo have become popular destinations for both retirees as well as foreigners seeking to live in a warm Mediterranean climate surrounded by the beauty of our islands! As such, renting or leasing a property is usually an attractive alternative to purchasing. With the new legal amendments by the local Government, both landlords and tenants are afforded a good level of protection when signing a rental lease. Most leases are long term, which is defined as being no less than 1 year and have certain conditions. In a 1 year lease, the first 6 months are mandatory, afterwards the Tenant may cancel the lease with a 1 month notice In a 2 year lease, the first 9 months are mandatory, afterwards the Tenant may cancel the lease with a 2 month notice In a 3 year or longer lease, the first 12 months are mandatory, afterwards the Tenant may cancel the lease with a 3 month notice. In call cases, if the Landlord decides not to renew the lease, the Tenant must be informed at least 3 months prior to the expiration, otherwise the lease is automatically renewed at existing terms, conditions and pricing. Our office is well versed in the law regarding leases and can provide the services involved with the drafting of Property Rental leases, the signing of such leases as well as the registration of the lease with the Housing Authority. No, we do not open on weekends, with the exception of emergencies. It is our policy that everyone needs some time off! What is a Certified True Copy? This is where the Notary will see an original document, such as an ID card, Drivers License, Passport, birth certificate, etc, A copy of this original document is then made, and copy of it is stamped and signed by her, confirming that the copy if an exact of the original. A copy cannot be certified as a true copy unless the Notary has compared it to the original. I have a copy of the original document, can you certify it as a True Copy? No. We can only certify a document as a True Copy if we have seen the original. What information is needed for the Promise of Sale? Prior to meeting for the promise of sale, the Buyers and Sellers must provide: - ID Cards or other identity documents - A copy of the deed showing how the Sellers purchased the property that they are now selling. - If the sellers received the property through inheritance (wirt), then a copy of the Transfer Causa Mortis must be provided Once the Notary has these documents as well as the details of the property in hand, she can draft the Promise of Sale. At which point, an appointment will be scheduled with the Buyers and Sellers to finalize the fine points and sign the document. What documents are needed to sign the lease agreement? Services Provided Donations Donations of Immovable Property A donation is the transfer of property from one individual to another without remuneration. As with most transfers of immovable property, donations incur duty on documents tax for the receiver of the property and property transfer tax for the person donating the property. However there are exceptions to this rule. For example, when property is donated by a parent to a child, no payment of property transfer tax is due by the parent, however payment of duty on document tax may be due by the child. In cases where the following criteria are met; the property is donated solely for the purpose of establishing residence and the child does not own any other immovable property at the time and it consists of the first donation between the parent and the child then no payment of duty on documents tax is due by the child on a portion of the value of said property. At the outset of a new transaction we will require some detailed information from all the parties which is either obligatory or deemed necessary for the proper discharge of particular obligations. In terms of Legal Notice 372 of 2017 Prevention of Money Laundering and Funding of Terrorism Regulations, our office, Gozo Notary - Dr. Anna Maria Mizzi and related staff are a Subject Person and we are legally bound to ensure that proper Customer Due Diligence (CDD) and Anti-Money Laundering (AML) procedures are followed through by having our client complete a "Know Your Client" (KYC) form, which provides us with the details that the Financial Intelligence Analysis Unit (FIAU ) requires we collect. Identification & Verification The Law requires subject persons to obtain satisfactory evidence of the identity of the parties and sometimes people related to them. This is because particular transactions involving a subject person may be used as a vehicle by criminals in order to legitimize their illicit gains. In this regard, we will ask for evidence of your identity as soon as possible upon your first meeting and will make copies of certain documents for identification purposes. For an individual, it is important to present yourself with a valid identification document (identity card, passport, driving license, etc.). We may also require a confirmation of your permanent residence by means of additional documentation, such as a recent utility bill. For an Entity, It is therefore important to: establish who are the qualifying beneficial owners or beneficiaries of the Entity (the qualifying beneficial owners or beneficiaries are those natural persons who, either own or control 25% or more of the shares or voting rights in the Entity or otherwise exercise control over the management of Entity); identify who are the directors or persons who manage the Entity; establish whether any beneficial owner, director or other person who manages or controls the Entity is a Politically Exposed Person. For these reasons the legal representatives or company secretary of the Entity are being requested to complete this form and to provide all documents required in terms hereof. Valid identification documentation (identity card, passport, driving license, etc.) of each one of the persons identified in this form must be provided. We may also require a confirmation of the permanent residence by means of additional documentation, such as a recent utility bill. Remittance of Funds For Transferees, some information about the source of such funds is required and the subject person may ask for any documentary evidence as deemed necessary. Should any part of a payment be made by a third party (a relative, a partner, etc.) the subject person is required to carry out the same CDD procedures on the third party.
